Abstract

It is known to those who understand the Sharia and delve into the depths of its precise rules; Let it be known with certainty that it was not left adrift or incoming, which humanity needs for the establishment of religion and the world, unless it stipulated that or referred to it through the establishment of the applicable rules, so that understanding could be controlled by it, and the directions of ijtihad and fatwa should be straightened within the general legal path established by the revealed revelation, without any flaw or error in it. Receiving through the correctness of the Qur’an, and understanding the sources of the noble Sharia, and not deviating and slipping in the efforts that deviate from the lines of justice and uprightness, while enclosing the subjects of the purposes that the Wise Legislator wanted. Her appointment resulted in good effects that are in line with the interests of the people in this life and the hereafter. Controlling diligence requires a wide area of understanding the evidence of the Qur’an and Sunnah in the way that fatwas are kept away from the will of God Almighty and the desire of His Messenger, may God bless him and grant him peace, and an awareness of the purposes that establish the balance of statement. Healing the jurisprudence of the legal rulings according to the evidence and circumstances surrounding the needs of individuals and societies, and to achieve insight into calamities with a keen eye, with full knowledge of the reasons for the rulings, the objectives of the texts, and the purposes of the evidence And understanding its meanings and the resources that were mentioned for it, each according to its reason and the occasion of its occurrence, then applying it to the modern reality whose events are emerging, and requires radical legal solutions, in a way that is consistent with the spirit of Sharia law, the loftiness of its goals, and the greatness of its lofty aims and objectives, so that it becomes a link with the issues of ijtihad with its correct tools.
