Will, Imam al-Hasan, to al-Qasim, its legal dimensionsAbstract
This research deals with a jurisprudential study of the will of Imam Al-Hasan (peace be upon him) to his son Al-Qasim (peace be upon him), in a letter before his martyrdom, regarding the necessity of supporting his uncle Imam Al-Hussein (peace be upon him) in Karbala. He did not withhold his life and was inclined to take the initiative in jihad and battle if the enemies surrounded al-Husayn, and he insisted that he be given permission to fight. This testament is considered an important pillar in the jurisprudence of defending the truth in the legal texts of the school of Ahl al-Bayt (peace be upon them), and it also represents an important model of the Karbala legal heritage in the first century AH. Because it reveals the profound divine plan for the continuation of Imam Hussein's (peace be upon him) cause throughout the ages This research aims to uncover the details of the will in terms of its content, timing, and outcome, and to emphasize the legal obligation to support and defend Imam Hussein (peace be upon him) when surrounded by enemies, highlighting the explicit permission for self-sacrifice (jihad). Al-Qasim (peace be upon him) was free from fear despite his young age and being an orphan, and the necessity of his complete commitment to the will of his father Al-Hasan (peace be upon him), and the way to reach the legal ruling through the verbal evidence to identify the connection of the will to the highest meanings of obedience to the guardian of the matter and its connection between defending the Imam and reaching eternal victory and martyrdom. For this reason, the will was considered a commitment and a covenant that must be implemented The study adopted a descriptive-analytical approach, directly reading the legal text and analyzing the structure of the hadith in a way that arranges the research content and its context in terms of relevance, application, and correct method. In this way, the will was described in meticulous detail.
