Abstract

The development of technology, modern techniques, and payment systems has led to a reduction in dependence on cash in daily transactions, and the use of electronic payment methods, which have become multiple, has begun to increase. The rest of the currencies, and therefore their rejection by most central banks, especially since they are characterized by decentralization, and there is no authority for the state or the central bank over them, in other words, there is no guarantor for encrypted currencies, but recently what is known as digital currencies has spread, which some central banks in the world have started Issuing or studying the possibility of this, therefore, it is necessary to search for the possibility of issuing them by the Central Bank, what are the motives for issuing them, the potential effects of these currencies, and the extent to which the current legislation covers these currencies in the field of issuance and management of these currencies in terms of controlling their circulation and providing protection for them in particular. Because it needs protection from a special form. Where the study dealt with the "legal problems in issuing the Central Bank of digital currencies" by explaining the concept of central banks in general and digital central banks in particular and with some expansion, and then dealt with the concept of digital currencies by defining their concept and explaining their legal nature in terms of their difference from current money in its form Known, it was necessary to study The appropriateness of the Central Bank Law to lay the legal foundations for the issuance of digital currencies. The study found the most important reasons and justifications for issuing the digital currency in light of the global trends of the concept of the digital currency of the Central Bank of the entire technological infrastructure, and the extent of the legal and technological readiness of the Central Bank of Iraq in issuing such digital cash currencies.
