Abstract

The crime of drug abuse is examined through an analytical, descriptive, and comparative methodology. The analytical method focuses on studying the laws and policies related to drug abuse and their social and economic impacts, while the descriptive method concentrates on the reality of the phenomenon in Iraq and the effects of legal penalties. The comparative method is used to highlight Iraqi legislation and policies in comparison to those applied in countries like Jordan, enhancing understanding of the available challenges and solutions. Sociologists define crime as a social phenomenon that contradicts the values of society, while criminal law defines it as an act that violates the rights of individuals and the community, warranting punishment. Laws in various countries aim to criminalize actions harmful to society, such as drug abuse, with the Iraqi legislator modifying penalties to protect public interest, while the Jordanian legislator adopts an approach that combines treatment and punishment for drug users. This research will address the definition of the crime of drug abuse, the prescribed penalties, and the legal means to mitigate this crime in both Iraq and Jordan.
